Erin Energy Corporation

This site has been created to provide unsecured creditors with information and to solicit and receive comments from unsecured creditors about the pending chapter 11 bankruptcy cases of Erin Energy and its affiliates.

NOTICE: On July 12, 2018, Judge Isgur converted the Erin Energy cases to chapter 7.

On April 25, 2018 Erin Energy Corporation, Erin Energy Ltd., Erin Energy Kenya Limited, and Erin Petroleum Nigeria Limited  commenced chapter 11 bankruptcy cases (together, "Erin Energy") in the United States Bankruptcy Court for the Southern District of Texas in Houston ("Bankruptcy Court"). Judge Marvin Isgur is the presiding bankruptcy judge. The Bankruptcy Court ordered that the cases be jointly administered under case number 18-32106. 

Committee Appointment

On May 16, 2018, the United States Trustee appointed members to a committee of unsecured creditors ("Committee"). Current Committee members (as reconstituted 5/30/18): Baker Hughes, Schlumberger Overseas S.A., Transocean Offshore Gulf of Guinea VII LImited and Indigo Drilling Limited, AOS Orwell Limited, and Armado Oyo Limited. The Committee has selected Pachulski Stang Ziehl & Jones LLP ("PSZJ") as its counsel; PSZJ's application for employment is pending. Ira Kharasch and Jeffrey Pomerantz are the principal attorneys at PSZJ responsible for this engagement.

Motion to Convert Cases to Chapter 7

On June 27, 2018, the Committee filed an expedited motion to convert the Erin Energy cases from chapter 11 to chapter 7 of the Bankruptcy Code because the debtors have experienced substantial and continuing losses and it is unlikely that the debtors' business can be rehabilitated. The motion was granted on July 12, 2018. See order.


On May 4, 2018, Erin Energy filed a motion to use cash collateral. The Bankruptcy Court entered an interim order on May 9, 2018, allowing Erin Energy to use a portion of available cash collateral. On June 15, 2018, Erin Energy filed a motion for an interim order seeking authorization to obtain postpetition financing. The Committee and secured creditor Public Investment Corporation both filed objections. On June 25, 2018, the Bankruptcy Court entered an interim order allowing the financing. A hearing to consider the entry of a final financing order will be held on July 12, 2018. Violation of Automatic Stay

On June 6, 2018, Erin Energy filed an emergency motion asserting that Zenith Bank took certain actions in Nigeria in violation of the automatic stay embodied in the Bankruptcy Code. Zenith Bank opposed the motion, asserting lack of personal jurisdiction. On June 19, the Bankruptcy Court heard the motion, and ruled that (i) the court had personal jurisdiction over Zenith Bank and (ii) that Zenith Bank had taken actions in violation of the automatic stay. The Bankruptcy Court issued an order on June 21, 2018, which ordered Zenith Bank to pay the Erin Energy's costs related to the motion and reverse its "transgressions, including but not limited to: (i) the appointment of the receiver/manager over Erin Petroleum Nigeria Limited; (ii) all lawsuit(s) and/or legal proceedings initiated against any of the Debtors or property of the estate, including the application to set aside the registration order of the Federal High Court and the collection lawsuit filed against EPNL and creditors; and, (iii) any other actions taken in violation of the automatic stay." Zenith Bank filed a notice of compliance with the order on June 26, 2018.
