Real estate is a significant component of the California economy. We have extensive experience in representing owners and creditors in cases involving troubled real estate.

Current Workout Projects and Bankruptcy Cases

The firm is currently representing large land developers and homebuilders in Las Vegas, Palm Desert, Southern California, Northern California and Connecticut in out-of-court workouts and chapter 11 cases.

Apex Holdings
We represent Apex Holdings, 800 acres of industrial land that is being restructured in a chapter 11 in Nevada with significant fraud overlays that caused the filing.

Palm Desert restructuring
We are handling an out-of-court restructuring of a developer of a 140-acre mixed-use development/ground lease from native Americans.

Empire Land LLC
We represent Empire Land and eight of its affiliated companies in their chapter 11 case pending in Southern California. The companies are residential land, homebuilding, and financing companies that develop masterplanned communities and other land and construction projects located mainly in California and Arizona.

Southern California land owner
We represent a Southern California land owner and home builder in the out-of-court restructuring of over 20 projects with in excess of $500 million of debt. The company has approximately 15 lenders with the complicated overlay that the principals of the company have guaranteed virtually all of the lender debt.

Northern California/Nevada homebuilder
The Firm represents a Northern California homebuilder with 21 communities and approximately $250 million in debt owed to six principal lenders in its out-of-court restructuring.

Land developer restructurings
We represent a multi-billion dollar real estate developer and home builder with projects throughout the United States in connection with the restructuring of over $900 million in debt.

We are advising on a potential filing of chapter 11 cases for one of Southern California's most influential privately owned and operated land developers whose businesses include acquiring and developing property for sale to homebuilders; overseeing the acquisition, development, and management of commercial, retail, multi-family properties and self storage facilities; and selling homes for a wide spectrum of buyers.

Connecticut condominium project
We represent a multi-billion dollar real estate investment firm in connection with the workout of approximately $250 million in financing secured by a 600,000 square foot condominium project in lower Connecticut.

San Francisco Housing Authority
We currently represent former San Francisco Mayor Art Agnos as receiver of the SF Housing Authority.

Scotia Pacific
We represent the creditors' committee in the chapter 11 case of Scotia Pacific Company LLC, owner of over 200,000 acres of timberlands in Humboldt County. The single-asset real estate issues in the case are currently the subject of a pending appeal to the Fifth Circuit.

Dunmore Homes
We represent this leading builder with 26 communities in various stages of development in its chapter 11 case. Dunmore Homes filed on November 8, 2007; the case is currently pending in Sacramento, California.

Prior Real Estate Representations

Baldwin Builders
We represented the principals and their affiliates in connection with the chapter 11 case of their construction company, one of California's largest residential homebuilders.

Commonwealth Equity Trust
We were chapter 11 counsel to this publicly traded real estate investment trust with hundreds of millions in assets.

Daley Corporation
We represented this Southern California public highway contractor in its chapter 11 case, in which we successfully confirmed a plan.

Guy F. Atkinson Company
One of the largest construction companies in the United States, with revenue in excess of $450 million in 1996, Atkinson built the Grand Coulee Dam, the United Nations headquarters and the Diablo Canyon nuclear power plant.

Heritage Hills
We represented the owner of a $60 million, 267-acre country club and residential development located in Rancho Santa Fe in San Diego County.

The Hollywood Roosevelt Hotel
We represented the major secured creditor of this landmark hotel in Hollywood, which sold for $24 million.

Imperial Hotels Corporation
We represented this owner of over thirty hotels in fifteen states.

Janss Corporation
We represented Janss Corporation in the global settlement of over $200 million in debts owed to institutional and private investors by various Janss entities.

Laura West Enterprises
We represented this land developer and holder of a land lease for a hotel property (now the "W" in Westwood) in their successful restructuring in Santa Barbara.

Teicert Land Company
Between 1997 and 2001,the firm represented Teicert Land Company, an affiliate of Teichert Construction Company, in two lawsuits and an arbitration arising out of three joint ventures between Teichert and Parker Development Company arising out of an approximately 3000 acre residential development at Serrano in El Dorado County, a 600-acre residential development in Folsom (Parkway) and an infill development in the "Pocket" area of Sacramento (Riverlake). All of the matters were concluded by settlement.

The Westin Bonaventure Hotel
We represented the creditors' committee in the chapter 11 case of this downtown Los Angeles landmark hotel, with $100 million of secured and unsecured debt.
