Settlement Reached in San Diego Diocese Chapter 11 Case
September 9, 2007

James I. Stang, Robert Orgel, Hamid Rafatjoo and Gillian N. Brown represented the Official Committee of Unsecured Creditors in the chapter 11 case of The Roman Catholic Bishop of San Diego. Through intensive litigation during the six months of the bankruptcy, the Committee thwarted the Diocese's strategy to force survivors of clergy sexual abuse to accept below average settlements. On September 7, 2007, the Diocese announced a settlement for 144 survivors and its intention to dismiss its chapter 11 case. The settlement represents the highest average per survivor settlement for any group settlement of claims against a Catholic diocese in the United States. Pachulski Stang Ziehl & Jones has represented more committees in Catholic diocese chapter 11 cases than any other firm in the country; representations include committees in the chapter 11 cases of the Diocese of Spokane and the Diocese of Davenport.

As a wave of customer defaults swept through the subprime mortgage lending industry in late 2006, reports of lenders seeking refuge from margin calls and buyback requirements placed on the warehouse lines and repossession agreement fundamental to their operations exploded. Without the confidence of the equity markets behind them, subprime mortgage lenders have been painted into a corner amid rising interest rates and customer turmoil.

Pagay Chairs Bar Association Bankruptcy Law Section

On October 1, 2006, Malhar Pagay became the chair of the Bankruptcy Law Section of the Beverly Hills Bar Association, a nationally recognized, 75-year old, major metropolitan bar association based in Beverly Hills, California. With over 3,600 members, it is the largest voluntary bar association in California that is not a county bar association.

Today, after many twists and turns, the Debtors' Fourth Amended Plan of Reorganization was confirmed in General Media, exactly one year to the day from the petition date. Whereas unsecured creditors and Penthouse founder Bob Guccione were threatened with extinction at the beginning of the case, unsecured creditors will receive cash and notes representing full payment of their claims, and Guccione will get a ten-year agreement and be paid $500,000 per year whether or not he works in his twilight years.
