Brad Sandler and Jonathan Kim’s article, “Navigating the Retail Apocalypse,” was recently featured in the New York Law Journal’s September 23, 2019 Corporate Restructuring & Bankruptcy “Special Report.” The authors discuss the staggering number of retail store closures and the resulting retail bankruptcies and focus on the circumstances surrounding retailer struggles, including the shift away from brick-and-mortar to online stores, compounded by retailer debt levels. The article studies the advantages and disadvantages of bankruptcy and touches upon the rejection of unfavorable leases and contracts, asset sales, and retailer operations postbankruptcy. The article concludes with guidance for the troubled retailer.
