Miscellaneous Bankruptcy Litigation Matters

Relief-from-stay proceedings frequently involve litigation over real estate, valuation, and reorganization issues. As the moving party, the firm has successfully advanced relief-from-stay litigation in hundreds of cases on behalf of lenders such as PaineWebber, Heller Financial, First Nationwide Bank, and Granite Asset Management and Disposition. In conjunction with our debtor practice, we also have broad-based expertise in the defense of relief-from-stay litigation.

The firm has prosecuted and defended many nondischargeability cases, which are akin to civil fraud actions and often present complicated issues of proof.

The firm successfully obtained an injunction against the County of Orange in its attempt to abrogate its labor agreements following its chapter 9 bankruptcy filing. We also litigated to protect grievance and seniority rights, and the employees' interests in deferred compensation funds.

We obtained a summary judgment for Pioneer Take-Out Corporation and won an appeal in favor of its bankruptcy trustee against the debtor's sole shareholder in an action that saved hundreds of restaurant leases for the benefit of creditors.

Representing the creditors' committee of Pannell Kerr Forster, a former accounting firm, we conceived and successfully brought a binding class action on behalf of over 1,000 creditors against hundreds of partners for the $50 million deficiency owed the estate. We also handled liability insurance coverage issues for professional negligence claims in excess of $250 million.
