Partner, Michael D. Warner Featured in American Bankruptcy Institute’s (ABI) Rochelle’s Daily Wire

We are pleased to share that Partner, Michael D. Warner was featured in the American Bankruptcy Institute’s (ABI) Rochelle’s Daily Wire, in an article titled “A Trustee Isn’t Confined to Suing in the District Where the Bankruptcy Is Pending.”

The article discusses the Adversary Proceeding filed by Mike, as Plaintiff, in the United States District Court, for the Eastern District of Louisiana against Brad Cox, and 25 other individuals and entities, arising out of the Chapter 7 Cases of MLCJR, LLC, et al. (Cox Operating), pending in the United States Bankruptcy Court, for the Southern District of Texas, in which Mike serves as the chapter 7 Trustee.

The Adversary Proceeding seeks hundreds of millions of dollars in recovery for creditors and asserts claims against officers, insiders, and affiliates of the Debtors. Following the filing of the Complaint the Defendants filed a series of Motions, including Motions to Dismiss for Lack of Personal Jurisdiction, Motions to Transfer Venue, and Motions to Dismiss the Adversary Proceeding.

On August 21, 2026 (2026 WL 2453468) and August 25, 2026 (2026 WL 2484578), the Honorable Brandon S. Long, US DC EDLA, issued two Orders denying several of the pending Motions.  The ABI article address the Judge’s first Order, and reports that the Court confirmed that a trustee is not confined to suing in the district where the bankruptcy case is pending as long as the lawsuit is related to the case or would augment the estate, and that nationwide service of process under the Bankruptcy Rules was sufficient to establish personal jurisdiction over defendants residing anywhere in the United States.
