Representation of the prepetition equity sponsor of the debtors in the chapter 11 case of Performance Powersports in the District of Delaware. The debtors manufactured and distributed dirt bikes, go-karts, ATVs, and golf carts to U.S. retailers throughout the country. With the firm’s assistance, the sponsor served as DIP lender and stalking-horse bidder—and subsequently the court-approved buyer—for substantially all of the debtors’ assets. The parties successfully closed the sale and a liquidating chapter 11 plan was confirmed.
