
Cross-Border Insolvency – Acting for an Unsecured Creditors’ Committee
Seventh Annual Pan-Canadian Insolvency and Restructuring Law Conference Toronto ON September 23, 2011Rob Feinstein will cochair this panel sponsored by the National Bankruptcy, Insolvency and Restructuring Section of the Canadian Bar Association. The panel will discuss the role of Canadian acting as special counsel to a creditors’ committee in a U.S. in a cross-border U.S. chapter 11 proceeding. Topics will include the retainer process, what conflicts can disqualify counsel from acting, and what it takes to get retained and paid. The panel will also discuss the role that Canadian counsel to the creditor’s committee can play in a Canadian insolvency proceeding, including issues of standing.
