He discusses Delaware’s adoption of the statute in June 2026, noting that it positions Delaware as a significant forum for ABCs given the state’s role as the state of organization for so many companies. “For many enterprise groups, Delaware now gives ABCs a forum that buyers and lenders can understand, with access to a sophisticated court when an order is useful,” Rob explains.
