Rick Mikels and Judge Harwood will discuss an apparent conflict among recent opinions  on two topics at this annual meeting of the American Bankruptcy Institute. The first is whether a bankruptcy court can enter a final order on a preference or fraudulent conveyance in the absence of the defendant filing a claim or otherwise objecting. The second topic deals with appeals of bankruptcy court sales orders and whether section 363(m) moots an appeal dealing with the rights of the debtor and the secured creditor to the proceeds of the sale.
