Representation of the creditors’ committee in the chapter 11 cases of Groff Tractor Mid Atlantic and its affiliate debtors in the Northern District of Texas. The debtors market and sell CASE brand and other branded construction equipment, parts and products, and filed their cases to pursue a sale of their assets. The committee, with the firm’s assistance, objected to the proposed DIP financing, with a creeping rollup of the lender’s prepetition debt, and successfully reached a settlement regarding the financing that will provide value for the estate’s creditors. Without the firm’s efforts, general unsecured creditors would likely have received nothing in the chapter 11 cases.
