Representation of the creditors’ committee in the chapter 11 cases of Worldwide Machinery Group and its affiliate debtors pending in the Southern District of Texas. Prior to the bankruptcy filing, the debtors were a prominent provider of heavy equipment for the construction and mining industries, including earthmoving machinery and material handling equipment, with facilities in Colorado, Utah, Texas, New Mexico, and North Dakota. The firm advised and assisted the committee in filing litigation against the debtors’ ABL lenders and others, alleging bad-faith actions taken prepetition by the lenders, including attempts to block the company’s pursuit of a going-concern sale. The firm succeeded in ultimately leveraging and negotiating a global settlement with the debtors and lenders, allowing for a value-maximizing going-concern sale of the debtors’ assets and a confirmed chapter 11 plan under which unsecured creditors will receive value from, among other things, proceeds from retained causes of action.
