Fulcrum Creditor Power: RSAs, DIPs, Backstops, and Other Tools of Creditor-on-Creditor Violence

We are pleased to share that Laura Davis Jones will serve as a panelist at the National Conference of Bankruptcy Judges’s (NCBJ) 2026 Annual Meeting on Friday, October 9 in San Diego, California. This year marks NCBJ’s 100th anniversary marking a century of judicial scholarship, professional fellowship, and steadfast commitment to the administration of justice. Laura’s panel entitled “Fulcrum Creditor Power: RSAs, DIPs, Backstops, and Other Tools of Creditor-on-Creditor Violence” will be moderated by the Honorable Alfredo Perez. The panel will discuss intra-class creditor conflicts, often referred to as “creditor-on-creditor violence,” in which a sub-group of creditors controls their class’s vote enabling them to receive special treatment from the debtor. Their discussion will cover the role of backstop agreements, debtor-in-possession agreements, and restructuring support agreements.
