Fold and Live to Fold Again: Perspectives on Mass Torts

Thirty-Fifth Annual California Bankruptcy Forum Insolvency Conference

Recent mass-tort bankruptcies such as PG&E, Purdue Pharma, Boy Scouts of America, LTL Management/J&J, Aearo/3M, and the diocese cases have attracted significant national attention not only from practitioners but also from the general public. Issues like the use of the "Texas two-step" divisive merger or the permissibility of nonconsensual third-party releases have begun a larger debate over how companies facing mass tort liabilities have used the Bankruptcy Code. Malhar Pagay will join a panel exploring the evolving landscape of mass torts as part of the California Bankruptcy Forum's conference.
