Roll the Dice: Cannabis Restructuring and Receiverships
Thirty-Fifth Annual California Bankruptcy Forum Insolvency Conference
Cannabis businesses have limited options when it comes to a winddown, workout, or liquidation. Because cannabis remains illegal at the federal level, cannabis-related businesses cannot seek protection from the bankruptcy court. State law options include restructuring, receivership, and assignments for the benefit of creditors. Jason Rosell will join a panel at the California Bankruptcy Forum's insolvency conference to discuss how the industry has matured, how the rights of secured vs unsecured creditors have evolved, equity partnership disputes, tax liabilities, and the licensing and regulatory effects at both state and local levels.
