The Catholic Church in Bankruptcy - Diocesan and Religious Order Chapter 11 Cases and the Lessons Learned

In order to deal with hundreds of millions of dollars in liability for child sex abuse by priests, the Society of Jesus Oregon Province ("Jesuits") and dioceses in Spokane, Tucson, Portland, San Diego, Davenport, Fairbanks, Wilmington and Milwaukee have filed cases under chapter 11.

James Stang and Ken Brown will be part of a discussion of some of the unique issues in these cases at this program sponsored by the Bay Area Bankruptcy Forum. Topics will include religious liberty principles and the Establishment Clause, scope of property of the estate, "tracing" requirements for financial assets held in trust, the impact of alter ego and substantive consolidation principles, protecting the confidentiality of abuse survivors, insurance issues, and the scope of plan discharge.
